Present petition under Section 438 Cr.P.C. for seeking pre-arrest bail to the petitioner in case FIR No. 79 dated 22.7.2014, registered under Section 15 of the Narcotic Drugs & Psychotropic Substances Act, 1985 at Police Station G.R.P., Amritsar.
Learned counsel for the petitioner contended that petitioner was earlier released on bail; he had been regularly appearing in the trial Court; on 1.5.2017 he could not appear in the Court; on that account his bail bonds were cancelled and he is ready to appear before the learned trial Court and submit fresh bail/surety bonds.
Learned counsel for the respondent-State that there had been no reason for absence of the petitioner on 1.5.2017 and present petition be dismissed.

No. M-27869 of 2017 parties and the fact that petitioner was earlier released on bail in this case and his bail bonds were cancelled by the learned trial Court on account of single default of non-appearance on 1.5.2017. In view of above, present petition is disposed of with a direction that petitioner shall surrender before the learned trial Court and move an application for his release on bail and the Court shall consider the application and decide the same on the same day without taking him into custody. However, the learned Court below shall be at liberty to complete the proceedings initiated under Section 446 Cr.P.C. (Shekher Dhawan) Judge August 30, 2017 "DK"
