This revision petition has been instituted under Article 227 of the Constitution of India for setting aside the impugned order dated 17.02.2026 (Annexure P-11) passed by the learned Civil Judge (Junior Division), Gurugram in Civil Suit No.227 of 2026 vide which the petitioner has been directed to deposit the amount in the Court. 2.

Mr. Saurbh Bhardwaj, Advocate has appeared and accepted notice on behalf of respondent No.1 and has filed his power of attorney, which is taken on record.

I have heard the learned counsel for the parties and have gone through the material on record.

At the time of arguments, both the parties have agreed that the order dated 17.02.2026 passed by the Civil Judge (Junior Division), Gurugram, vide which defendant No.2 has been directed to deposit the VISHAL VARDHAN 2026.03.13 15:20 I attest to the accuracy and integrity of this document

 

entire amount in Court in the form of Fixed Deposit (FD) be modified to the effect that defendant No.2 shall get an FD prepared in his name and the same shall be deposited in the Court so that there is no loss of interest. It has also been agreed that defendant No.2 shall neither take any loan against the said FD nor get the same encashed and shall furnish an undertaking in this regard before the Trial Court, Gurugram. 5.

Resultantly, the present revision petition is disposed of with the aforesaid modification.

Pending miscellaneous application(s), if any, shall also stand disposed of.
