***** ARCHANA PURI, J. (Oral) Along with the main appeal, filed for seeking enhancement of compensation, the present application i.e. CM-8966-CII-2023 has been filed for seeking condonation of delay of 285 days in filing the same. Keeping in view the averments made in the application, same is allowed and delay of 285 days in filing the appeal, is hereby condoned. Main case Perusal of the impugned order reveals that the claim petition was initially filed by Meena Devi, widow as well as the mother and children of the deceased, on account of his death, which took place on 21.11.2018, in a motor vehicular accident.

Considering the evidence brought on record, an amount of Rs.15,82,000/- was awarded. Still not satisfied with the extent of compensation awarded, the appeal, in hand, was filed and with the Sonu 2025.12.12 15:19 I attest to the accuracy and authenticity of this document

2025:PHHC:173192 FAO-2519-2023 (O&M) intervention of the Mediator, settlement has reached between the parties, in view of the terms, as recorded therein.

Report from the Mediation and Conciliation Centre received and pursued.

As per the same, settlement has reached between the parties and the Insurance company has agreed to pay a sum of Rs.3,10,000/-, over and above the awarded amount of Rs.15,82,000/-.

Also, it is stated that as per paragraph No.3 of the settlement, the requisite enhanced amount, shall be paid by virtue of cheque, in the name of Meena Devi, widow of the deceased, Subhash, within a period of 45 days from the date of passing of the order, passed by this court. There is also penal interest clause of 9% per annum, in case of any default. Considering the same, the appeal, in hand, is hereby allowed and the Insurance Company, is directed to pay a sum of Rs.3,10,000/-, as agreed, over and above the amount already awarded and the requisite amount shall be paid by the Insurance company, by virtue of cross-cheque/account payee cheque, in the name of Meena Devi, within a period of 45 days from today onwards, failing which, the Insurance Company shall be liable to pay penal interest at the rate of 9% per annum, as agreed.
