1. Anticipating his arrest the petitioner has applied for grant of anticipatory bail in a case registered vide FIR No.104 dated 18.5.2020 under Sections 51(b) of Disaster management Act, Sections 188 & 269 IPC and Section 22(c) of Narcotic Drugs and Psychotropic Substances Act, Police Station Sadar Tohana, District Fatehabad.

2. It is the case of prosecution that co-accused Navdeep Singh was apprehended while in possession of 350 strips of Tramadol Hydrochloride total weighing 1 kg. 462 grams. Upon interrogation, he disclosed that he had purchased the same from co-accused Ramesh. Further, it was pursuant to the statement made by said Ramesh that the petitioner came to be nominated as an accused allegedly being supplier of said contraband. 3. Pursuant to interim directions issued by this Court on 12.6.2020, the petitioner has joined investigation as has been confirmed by learned State counsel upon instructions from ASI Prem Kumar. It has been informed by learned State counsel that the petitioner is not involved in any other case.

4. Having regard to the facts and circumstances of the case especially that the petitioner has beeen nominated on the basis of disclosure statement and was not apprehended at the spot and has since joined investigation, the petition is accepted and the interim directions issued by this Court vide order dated 12.6.2020 are hereby made absolute subject to the condition that the petitioner shall continue to appear before the Investigating Officer as and when called upon to do so and shall also abide by the conditions as provided under Section 438 (2) Cr.P.C.
