IN THE HIGH COURT OF PUNJAB AND HARYANA

AT CHANDIGARH CRM-M-28864 of 2018 Date of decision: 31.10.2018 Sameer Anwarali Merchant and another .........Petitioners versus State of Haryana .........Respondent CORAM: HON'BLE MR. JUSTICE RAMENDRA JAIN Present:- Mr. Tribhawan Singla, Advocate, for the petitioners. Mr. Vikas Chopra, DAG, Haryana.

RAMENDRA JAIN, J. (ORAL) Through this petition under Section 439 Cr.P.C. prayer has been made for grant of regular bail to the petitioners in a case arising from FIR No.495 dated 13.11.2017 registered under Sections 406, 419, 420, 467, 468, 471 and 120-B IPC at Police Station Ambala City, District Ambala. Learned counsel for the petitioners inter alia contends that name of petitioner No.2 was nowhere mentioned in the FIR. Petitioners are in custody since 31.03.2018. Conclusion of trial may take a sufficient long time. No recovery has to be effected from the petitioners. No useful purpose would be served by keeping the petitioners in jail any more.

Considering the seriousness of allegations against the petitioners that they duped the innocent public at large for around `37,60,000/- by opening bank accounts on the basis of forged and fictitious papers and that four more cases of cheating against the petitioners in different States are registered, this Court is not inclined to grant bail to the petitioners, RAVINDER SINGH 2018.11.

-2CRM-M-28864 of 2018 committing fraud and cheating.

In view of above, petition is dismissed.
