The petitioner is alleged to have cheated the complainant Anju Garg in the year 2011 by selling the property to her without disclosing that it was mortgaged with State Bank of India. Counsel for the petitioner has drawn attention of this Court to documents Annexure P8 and P11, report of Sub Inspector, Police Station, Barnala, dated 21.5.2015 and repot of Panchkula Police dated 28.5.2015, respectively to indicate that on the similar allegations complaints were made at different places but the allegations were found to be not worthy of launching prosecution.

CRM-M-27910-2015 (O&M) Besides this, it is sufficient to observe that the mortgage has already been redeemed on 21.1.2014 and the complainant has got the clear title.

State counsel on the instructions of SI Charanjit Singh informs that the petitioner has joined investigation. It does not appear to be a case of custodial interrogation. The petition is allowed. It is ordered that in case of arrest of the petitioner he shall be released on bail to the satisfaction of arresting officer subject to the conditions that he will join investigation as and when required and will not tamper with the evidence or hamper investigation in any manner.
