This is an application seeking permission to place on record the statements of the complainant and other independent witnesses as Annexures P-2 to P-4.
For the reasons mentioned in the application, the same is allowed. Documents Annexures P-2 to P-4, annexed with the application, are taken on record.
Main Case :
The present petition has been filed by the petitioner under Section 439 of the Cr.P.C. for grant of bail pending trial in case FIR No. 479 dated 27.9.2016, registered under Section 364 IPC, at Police Station Safidon, District Jind.
The perusal of the record shows that earlier the petitioner was granted bail in this case. However, he stopped appearing before the trial Court on 17.2.2018. The petitioner might have been arrested in another case in the meantime, therefore, the petitioner was produced before the trial Court on production warrants on 10.4.2019. CRM-M No. 14980 of 2020 (O & M) -2to have committed more offences under the NDPS Act, 1985. Besides this, as per the status report filed by the police, the petitioner is already having 15 cases against him. Not only this, the counsel for the State has pointed out that the petitioner has already been convicted in five cases under Section 174A IPC. Hence, this shows that the petitioner is habitual absentee from the Court.
In view of the above, this Court does not find any ground to release the petitioner on bail.
Dismissed.
