This order shall dispose of two petitions bearing CRM-M27980-2017, filed by Gurjit Singh @ Gita & Sahab Singh and CRM-M27987-2017, filed by Jaswinder Singh @ Jassa Singh & Joginder Singh, under Section 439 Cr.P.C., praying for grant of regular bail in case FIR No. 51 dated 07.04.2017 (Annexure P-1), registered under Sections 323, Rishu Kataria 2017.08.10 17:47 I attest to the accuracy and authenticity of this document 324, 325, 326, 341, 506, 427, 148, 149 IPC at Police Station Odhan, District

Allegations against the petitioners are that in the evening of 06.04.2017, the petitioners along with their companions, total 7 in number caused injuries to Mangal Singh, Sarpanch and Harpreet Singh with their respective weapons like lathis, danda, axe, gandasis and khurchana, while the aforesaid injured persons were making arrangements to fill water in the village pond.

Learned counsel for the petitioners contend that the petitioners are in custody since 19.04.2017. Final report under Section 173 Cr.P.C. has been filed and charges have also been framed against the petitioners. Nothing has to be recovered from them. The injury which falls under Section 326 IPC inflicted upon Harpreet Singh, is not on the vital part of his body. No specific role has been attributed to any of the petitioners. 4.

On the other hand, learned counsel for the State assisted by learned counsel for the complainant has vehemently opposed the submissions made by learned counsel for the petitioners. 3.

Considering the overall facts and circumstances of the case; without discussing the facts in minute detail and without expressing any opinion on the merits of the case, both the petitions are allowed and all the petitioners, namely; Gurjit Singh @ Gita, Sahab Singh, Jaswinder Singh @ Jassa Singh and Joginder Singh, are ordered to be released on bail, subject to their furnishing adequate bail bonds/surety bonds to the satisfaction of the trial Court/Duty Magistrate.
