CRM-25957-2017 Criminal Misc. Application is allowed, subject to all jut exceptions. Report of Warrant Officer is taken on record as Annexure P5. CRM-M-27990-2017 Present petition under Section 438 Cr.P.C. for grant of pre-arrest bail to the petitioner(s) in case FIR No. 49 dated 21.5.2017 registered under Section(s) 353, 341, 294, 506, 147, 149 & 186 IPC at Police Station Banur, District S.A.S.Nagar (Mohali).
Learned counsel for the petitioner contended that the report submitted by the warrant officer is apparently on wrong facts and the entire incident was videographed. Even the petitioner levelled allegations of raising demand of bribe money by the warrant officer and as the same object was not achieved, he had submitted this false report. Criminal Misc. No. M-27990 of 2017 (O&M) Having considered the matter in its entirety and the report submitted by the warrant officer, appointed by this Court, there is absolutely no ground for release of petitioner on pre-arrest bail. Hence, the present petition stands dismissed.
