Petitioner as a member of an unlawful assembly allegedly entered the land of the complainant and assaulted the complainant and others.

So far as the petitioner is concerned, he has not been specifically attributed any injury but there are general allegations. As per the police record no grievous injury is attributed to the petitioner. Petitioner having joined investigation, it does not appear to be a case of custodial interrogation and the dispute is pertaining to land purchased by Jaswant Singh while the petitioner claims to be in possession.

CRM-M-28042-2014 (O&M) possession of the property, it is sufficient to observe that the petitioner has joined investigation and it is not a case of custodial interrogation.

The petition is allowed. Interim order dated 5.9.2014 is hereby made absolute subject to all the conditions under Section 438 (2) Cr.P.C., with an additional condition that the petitioner will not commit the similar offence of which he is accused of during pendency of the trial.
