(ORAL) CRM-15687-2020 Through this application filed under Section 482 Cr.P.C., prayer has been made for adding offence under Section 181 of the Motor Vehicles Act, in the head note and prayer clause of main petition (CRM-M15070-2020). Heard.
For the reasons mentioned in the application which is supported by an affidavit, the same is allowed. Registry is directed to make necessary corrections in the head note and prayer clause, accordingly. CRM-15687-2020 in/and CRM-M-15070-2020 -2been made for grant of anticipatory bail to petitioner-Sohan Singh Uppal, in case FIR No. 0036 dated 27.05.2020 registered under Sections 78(2) and 61 of the Punjab Excise Act, 1914 (Sections 420, 465, 467, 468, 471 and 120-B IPC, added later on) and Section 181 of the Motor Vehicles Act, Police Station Mukandpur, District Shaeed Bhagat Singh Nagar. On instructions from ASI Balwinder Singh, learned State counsel submits that petitioner has joined the investigation and is no more required for interrogation.
Having considered the facts and circumstances of the case, order dated 23.06.2020 passed by this Court is made absolute. However, the Investigating Officer, is directed to receive every evidence documentary or otherwise being produced before him by complainant-Rana Sugars Ltd. He will also record statements of the concerned authorities of Excise Department i.e. Excise Officer/Excise Inspector, whosoever was incharge at the relevant time. In such a big recovery case, conduct of ASI Balwinder Singh, for not asking the custodial interrogation of the petitioner is doubtful.
