(ORAL) Prayer in the instant petition under Section 482 Cr.P.C. has been made for quashing the impugned order dated 08.10.2015 (Anenxure P-1) passed by learned Judicial Magistrate Ist Class, Moga, in criminal complaint No.42 dated 20.11.2013 under Sections 365, 326, 324, 323, 148, 149 IPC whereby the petitioner has been declared as proclaimed offender. Having heard learned counsel for the petitioner and after perusing the paper-book, however, without commenting on merits of the case, petitioner is relegated to the trial Court for making the same prayer which he has made before this Court to seek his redressal. In case, petitioner appears before the trial Court, he shall be released on ad interim bail subject to his furnishing bail bonds and surety bonds to the satisfaction of the trial Court till the disposal of his application for setting aside the order dated 08.10.2015 (Annexure P-1). Disposed of accordingly.
