State of Haryana and another .............Respondent CORAM: HON'BLE MR.JUSTICE JASWANT SINGH Present:- Mr.Satish Chaudhary,Advocate for the petitioners Mr.RK Doon,AAG Haryana Jaswant Singh,J.(Oral) Prayer is for quashing of FIR No.75 dated 6.5.2015 for the offence under Section 379 IPC, PS Mullana,Distt.Ambala(P-1) and all consequential proceedings arising therefrom on the basis of compromise(P-2) arrived at between the parties. Vide order dated 21.8.2015 while issuing notice of motion parties were directed to get their statements recorded before the Court concerned regarding genuineness of the compromise. In compliance thereof, learned JMIC,Ambala vide his report dated 25.9.2015 (taken on record as Mark-A) has reported that all the complainants are not signatory to the compromise in question and 76 bags of stolen wheat are yet to be recovered and as such the compromise does not appear to be genuine.

CRM-M 27974/2015 At the time of hearing,learned counsel for the petitioners states that affidavits of all the aggrieved persons have been sworn who have admitted execution of the compromise deed. He,however, in view of the report of the JMIC,Ambala prays for permission to withdraw the present petition to pursue the matter before the Investigating Officer. Dismissed as withdrawn with liberty aforesaid. 16.11.2015.
