Through this petition under Section 439 Cr.P.C., petitionerGursharan Singh, has prayed for grant of regular bail in case FIR No. 185 dated 24.07.2014 registered under Section 420 IPC at Police Station Jagraon, District Ludhiana.

According to the prosecution, after release on regular bail, the petitioner while facing the trial in the aforesaid case, absented himself on 21.04.2015. Therefore, he was declared proclaimed offender by the trial Court vide order dated 22.08.2016. He was arrested and produced before the trial Court on 07.04.2017. Since then the petitioner is in custody. 3.

Learned counsel for the petitioner contends that the petitioner is in judicial custody since last more than six months on account of his absence on a single date during trial. He further submits that the conclusion of the trial would take long time and no useful purpose would be served by keeping the petitioner in custody.

On the other hand, learned State counsel vehemently opposed the bail to the petitioner.

Considering the overall facts and circumstances of the case, but without expressing any opinion on the merits and also that conclusion of the trial may take time, the instant petition is allowed. Petitioner-Gursharan Singh, is ordered to be released on bail pending trial, subject to his furnishing heavy bail bonds and two surety bonds to the satisfaction of trial Court, Ludhiana.
