R.P. Nagrath, J. (Oral) Petitioner seeks anticipatory bail under Section 438 Cr.P.C. in FIR No. 58 dated 04.07.2014 for offence under Section 498-A of Indian Penal Code (IPC), registered at Police Station Kanwan, District Pathankot.
The marriage of complainant and the petitioner was solemnized on 21.07.2013. The petitioner immediately after marriage started maltreating and harassing the complainant. A complaint was made to the police on 06.03.2014 on which the enquiry was conducted. The instant FIR was registered on 04.07.2014. The allegation against the petitioner was that there was a demand of motorcycle and ` 50,000/- cash. The complainant and the petitioner were known to each other for five years.
Learned State counsel on instructions from ASI Kidar Singh submits that the petitioner has joined the investigation on JITENDER KUMAR 2015.04.01 14:07 I attest to the accuracy and authenticity of this document Chandigarh
CRM-M-28102 of 2014 -228.08.2014 and is stated to be no more required for further investigation. It is further submitted that the only accused person is petitioner the husband of the complainant. It is also stated on instructions that Section 406 IPC has not been added. The matter was also referred to the Mediation and Conciliation Centre of this Court but despite various sittings the mediation between the parties failed.
In view of the above, the interim bail granted vide order dated 20.08.2014 is made absolute. Petitioner shall also abide by the conditions contained in Section 438(2) Cr.P.C. Allowed in the above terms.
