M.M.S. BEDI, J (ORAL) The petitioner is mother of two children. Her husband after coming from Dubai on account of head injury 7-8 months prior to the occurrence was unemployed. He committed suicide. As per the allegations of complainant Karam Kaur, mother-inlaw of the petitioner, her husband committed suicide by consuming poison on account of the fact that the petitioner had allegedly affair with one Paramjit Singh.
With the assistance of State counsel, I have gone through the police file and find that except for the sole testimony of the complainant there is no material till date on the record regarding the relationship of the petitioner with Paramjit Singh. The petitioner pursuant to interim orders has already joined investigation. In view of above circumstances, it does not appear RAJ KUMAR ARORA 2015.02.26 17:41 I attest to the accuracy and integrity of this document
CRM-M-28114-2014 (O&M) to be a case of custodial interrogation.
Without expression of any opinion on merits of the case, the petition is allowed. Interim order dated 20.8.2014 is hereby made absolute subject to the conditions that the petitioner will join investigation as and when required and will not tamper with the evidence or hamper investigation, in any manner. She will also not browbeat the complainant or the witnesses.
