*** Sudhir Mittal, J. (Oral) During the course of partition proceedings, the petitioners had objected to the Naksha Bey allegedly because the same was contrary to the accepted mode of partition. However, the objections were rejected by the Assistant Collector. An appeal was filed against this order but the same was dismissed on the ground that no appeal is maintainable once Sanad has been issued. A revision was filed against the appellate order which has also been dismissed on the same ground. Learned counsel for the petitioners has argued that the appellate and revisional orders were illegal as copies of the Sanad have not been supplied to the petitioners till date despite applications having been filed for the said purpose. Merely because a copy of the Sanad has not been made available would not change the legal position.

Admittedly, Sanad has been issued and thus, appeal was not maintainable. In revision, the appellate order alone had been challenged and, therefore, the revisional Court was justified in dismissing the revision petition. In view of the above reasons, the writ petition has no merit and is dismissed.
