(Oral) This is a petition filed under Section 482 Cr.P.C. seeking quashing of the order dated 06.06.2015 passed by the Judicial Magistrate Ist Class, Rewari, dismissing application of the petitioner/complainant under Section 319 Cr.P.C. for summoning additional accused as well as order dated 12.05.2016 passed in revision by the Additional Sessions Judge, Rewari.
Learned counsel appearing on behalf of respondents No.2 and 3 submits that the trial Court has decided the case and vide judgment dated 26.04.2017, has already acquitted the accused, namely, Sudershan and Rameshwar. Counsel has also placed on record certified copy of the judgment dated 26.04.2017 passed by JMIC, Rewari, which is taken on record as Annexure A1.
In view of the submissions made by learned counsel for respondents No.2 and 3, the present petition is dismissed having been rendered infructuous. However, it will be open for the petitioner to raise all available pleas raised in the present petition in case he file any appeal against the order of acquittal.
