Petitioner - Rohtash, aged about 48 years, has filed present writ petition for challenging the award dated 14.08.2020 (Annexure P-1) passed by learned Industrial Tribunal-cum-Labour Court, Hisar, whereby reference No.36 of 2018 under Section 10 (1) (c) of the Industrial Disputes Act, 1947, has been answered against him. 2.

Learned Labour Court has given a specific finding to that effect that the petitioner - workman had tried to build up his case, solely on the basis of the document, wherein the petitioner is shown to be working as Part Time Peon in Government Middle School, Chuli Khurd, District Hisar, from the period 08.10.2002 till 28.02.2003. As the petitioner - workman failed to discharge his onus to prove his working with the school by summoning the same from the documentary evidence, reference has been answered against him. Mr. Praveen Chander Goyal, Additional A.G. Haryana, while appearing on advance notice, submits that the alleged date of termination of the petitioner - workman is 28.02.2003 and the reference is of the year 2018. Therefore, the same suffers with a huge delay. Even, the impugned award had been passed on 14.08.2020, and present writ petition has been filed in the year 2024.

Thus, this Court does not find any reason to interfere with the findings recorded by learned Industrial Tribunal-cum-Labour Court. 5.
