HARINDER SINGH SIDHU, J Prayer is for grant of regular bail in case FIR No.109 dated 28.10.2019 under Sections 286,188,427 IPC and Section 3,4,5 of Explosive Substances Act, 1908 registered at P.S Division No.1, Jalandhar Commissionerate.

The FIR was registered against unknown persons with the allegations that a blast had taken place in open plot No.67 which is enclosed with boundary walls at Salempur Musalmana Road Baba Mohan Dass Nagar Gali backside cremation ground. Due to the blast, number of cars and houses were damaged. Upon investigation, the petitioner has been held responsible for the alleged blast.

Learned counsel for the petitioner submits that the persons, who had suffered loss due to the illegal action of storing explosive substance, have been duly compensated as per recommendations of the MANOJ KUMAR 2020.06.30 14:01 I attest to the accuracy and integrity of this document

This fact has also been recorded by this Court vide order dated 18.05.2020 passed in CRM-M-22 of 2020 whereby co-accused Gurdeep Singh @ Gora has been ordered to be released on bail. He submits that the petitioner is entitled to the similar relief. It is stated that the explosive licence already stands expired and the petitioner has not applied for any such licence.

Opposing the petition, the learned State counsel has submitted that the challan in the present case has been presented on 27.02.2020. Without commenting anything on the merits of the case and also bearing in mind the fact that the petitioner is not wanted in any other case, in my opinion, no useful purpose will be served by detaining the petitioner behind bars any further. The petition, as such, is accepted. The petitioner Harjinder Singh @ Jindu is ordered to be released on bail on his furnishing bail bonds/surety bonds to the satisfaction of learned trial Court/Chief Judicial Magistrate/Duty Magistrate concerned. The petitioner shall, however, file an undertaking before the trial Court/Duty Magistrate that he would not indulge in any such activity in future.
