***** ARCHANA PURI, J. (Oral) As per the observations made in the order dated 03.11.2025, despite service, the respondent did not make appearance on that date. Even today, he has not made appearance. As such, the respondent is proceeded against ex parte.

Counsel for the applicant heard.

The applicant-wife has filed the present application for seeking transfer of the petition under Section 13 of the Hindu Marriage Act i.e. HMA/196/2024, titled 'Surender Singh Vs. Jaspreet Kaur', filed by the respondent-husband, pending in the Family Court, Fatehabad and she seeks transfer of the same to the Court of competent jurisdiction at Hansi, District Hisar.

At the very outset, it is submitted by the counsel for the applicant that the marriage between the parties to the lis, had taken place on 27.02.2022. One daughter born from the said wedlock, is in the care and Sonu 2025.11.13 17:17 I attest to the accuracy and authenticity of this document

TA-337-2025 custody of the applicant. Also, it is submitted that at the time, when the applicant was turned out of the matrimonial house, she was on family way and thereafter, she had given birth to a daughter, at her parental place. The applicant is not having any source of earning. She is interested for her rehabilitation. However, the respondent is not inclined for the same. The distance between the two places is stated to be about 75 kms. Considering the aforesaid constrained circumstances, more particularly, considering the fact about the applicant taking care of the minor daughter and above it, considering the fact about the respondent having not come forward to resist the application, the transfer application is allowed and the petition under Section 13 of the Hindu Marriage Act i.e. HMA/196/2024, titled 'Surender Singh Vs.

Jaspreet Kaur', filed by the respondent-husband, stands transferred from the Family Court, Fatehabad, to the Court of competent jurisdiction at Hansi, District Hisar. The requisite record of the aforesaid case be sent by the Family Court, Fatehabad, to the District and Sessions Judge, Hisar.

Learned District and Sessions Judge, Hisar, shall assign the said petition to the Family Court (Camp Court) Hansi. Even, the parties are directed to appear before the Family Court (Camp Court) Hansi, within a period of one month from today onwards.
