(Oral) This is a petition for anticipatory bail filed under Section 482 of Bharatiya Nagarik Suraksha Sanhita, (BNSS), 2023 in case bearing FIR No.5 dated 07.01.2025 under Sections 420, 406, 120-B IPC and Section 13 of Punjab Prevention of Human Smuggling Act, registered at Police Station Civil Line, Patiala.

Learned counsel for the petitioner contends that the petitioner has been named as an accused in the aforementioned FIR wherein it is alleged that an amount of Rs.38000/- was transferred by the complainant to the petitioner's account at the behest of Paramjit Singh, who is son of the petitioner. The petitioner is stated to be of more than 65 years of age and has nothing to do with the said transaction or in promising the complainant to send his son and nephew abroad.

This Court, vide order dated 20.03.2025, had directed the petitioner to appear before the Investigating Officer and join investigation and in the event of his arrest, he was ordered to be released on ad-interim bail to the satisfaction Sonia Puri 2025.05.05 18:00 I attest to the accuracy and integrity of this document

Learned State counsel states that the petitioner has joined the investigation and is not required for custodial interrogation. 5.

In view of the submissions of learned counsel for the petitioner especially when the petitioner having joined investigation, the order dated 20.03.2025 granting interim bail to the petitioner is made absolute. 6.

However, the petitioner shall abide by the conditions stipulated under Section 438(2) Cr.P.C. He shall also join investigation as and when called upon to do so.

The petition stands allowed.
