This petition has been filed under Section 438 Cr.P.C. for the grant of anticipatory bail in case FIR No.72 dated 15.3.2016 registered for the offences under Sections 420, 406 and 120-B IPC and Section 3 of Haryana Protection of Interest of Depositors Act, 2014 at Police Station Pinjore, District Panchkula.

Notice of motion has been issued in this case. Mr. B.S. Virk, learned Deputy Advocate General, Haryana has put in appearance on behalf of the respondent-State and contested this petition.

I have heard learned counsel for the petitioner and learned State counsel appearing for the respondent-State and have gone through the Harpal Singh Parmar 2017.08.19 15:35 I attest to the accuracy and authenticity of this document Chandigarh

From the record, I find that firstly the present petitioner is not named in the FIR. No allegation has been levelled against her regarding any inducement or that she has received any money from the complainant. There is also no allegation in the FIR qua cheating or any criminal conspiracy against her. The allegation is levelled only during investigation that the money received by the main accused has been given to the present petitioner for investment purposes etc. No useful purpose will be served by sending the petitioner to custody.

In the facts and circumstances of the present case, without discussing the facts in minute detail and without expressing any opinion on the merits of the case, I accept this criminal miscellaneous petition and in the event of arrest, the petitioner shall be admitted to bail on her furnishing personal bonds and surety to the satisfaction of the Arresting/Investigating Officer. The petitioner shall join the investigation as and when called upon to do so and shall abide by the conditions of Section 438 (2) Cr.P.C.
