Having not been arrested from the spot; no recoveries having been effected from the petitioners and main accused Mohd. Javed and Mushtak, having been arrested, the petitioner can be granted the concession of pre-arrest bail.

The petition is allowed and interim order dated 28.1.2016 is hereby made absolute subject to all the conditions u/s 438(2) Cr.P.C. The petitioners will not commit the similar offence, of which they are accused of, during pendency of the trial.
