Petitioner has filed this second petition under Section 439 of Cr.P.C. for grant of regular bail in case FIR No. 400 dated 31.07.2019 registered under Sections 302, 452, 34, 120-B IPC and Section 25 of the Arms Act, at Police Station Ambala Cantt., District Ambala. Learned counsel for the petitioner states that there is no evidence connecting the petitioner with the crime and he has been in custody since 07.08.2019. Even in the FIR, the reference is that three young boys came in a car and gave fire shot injuries to deceased-Satwinder Singh@Kaka. There is no attribution of any injury to the petitioner. Copy of reply by way of affidavit of Deputy Superintendent of Police, Ambala, submitted by the learned State counsel through email is taken on record. He submits that co-accused is yet to be arrested. Challan has been presented and charges are yet to be framed. The petitioner has been involved in 3 other cases, out of which in 2 case he has been acquitted and in 1 case he has been convicted and sentenced for 5 years. I have heard the learned counsel for the parties. The petitioner has been in custody since 07.08.2019 and charges are yet to be framed, the trial will take time to conclude and no useful purpose would be served by detaining the petitioner behind the bars. !
