Through this petition under Section 439 Cr.P.C., the petitioner has prayed for grant of regular bail in case FIR No. 93 dated 02.03.2017 (Annexure P-1) registered under Sections 379-B, 379 and 411 IPC at Police Station Civil Lines, Amritsar.

Learned counsel for the petitioner contends that the co-accused of the petitioner, namely; Manpreet Kaur has already been granted the concession of bail, vide order dated 01.04.2017 (Annexure P-3) passed by the learned Additional Sessions Judge, Amritsar and, thus, treating the case of the petitioner on the same parity, he be released on bail. 3.

On the other hand, learned State counsel vehemently opposed the submissions made by learned counsel for the petitioner. Learned State counsel has filed the custody certificate of the petitioner in Court today. The same is taken on record. According to the same, the petitioner is in custody since 29.04.2017.

I have given my anxious consideration to the submissions made by learned counsel for the parties.

Considering the overall facts and circumstances of the case and the fact that co-accused of the petitioner, namely, Manpreet Kaur, has already been granted the concession of bail, the petitioner is at least deserves the concession of regular bail.

Thus, without expressing any opinion on the merits of the case and also that the trial is likely to take time, the instant petition is allowed and the petitioner is ordered to be released on bail, subject to his furnishing adequate bail bonds/surety bonds to the satisfaction of the trial Court/Duty Magistrate.
