RAMENDRA JAIN, J. (ORAL) Through this petition under Section 438 Cr.P.C. prayer has been made for grant of anticipatory bail to the petitioner in case FIR No.70 dated 22.02.2018 registered under Sections 353, 186, 506 and Section 61 of the Excise Act at Police Station City Barnala, District Barnala. According to the prosecution, co-accused Harpreet Singh was arrested with illicit liquor on the basis of secret information, who during investigation in his disclosure statement, named the petitioner as his vendor from whom he used to purchase illicit liquor. Consequently, police party headed by ASI Ranjit Singh raided the house of the petitioner and his brother Ram Singh.

Petitioner initially scuffled with the police party, rip off uniform of complainant ASI Ranjit Singh and then threatened to commit suicide by pouring kerosene oil upon him to falsely implicate the police party. Petitioner's brother Ram Singh also, in aggression, threatened the police party to see it before this Court. After extending above threats, RAVINDER SINGH 2018.09.21 10:52 I attest to the accuracy and authenticity of this document petitioner and his brother Ram Singh fled away. Their wives also came out of the house and scuffled with lady Constable Veerpal Kaur.

-2CRM-M-29204 of 2018 extended threat of committing suicide by putting kerosene oil upon them to blame the police for their suicide.

Learned counsel for the petitioner inter alia contends that it is highly improbable that two persons would succeed in fleeing away from the police party consisting of five police officials. The entire prosecution story is false.

On the other hand, learned State counsel, on instructions from ASI Surinder Pal, vehemently opposing the anticipatory bail to the petitioner contends that petitioner was earlier booked in three more cases of heinous nature and in one of them he has been convicted. Brother of the petitioner Ram Singh has been booked in 12 more cases of heinous nature. They are habitual offenders and have no fear of law. Considering above allegations in the FIR against the petitioner, this Court is not inclined to grant anticipatory bail to the petitioner. Dismissed.
