**** HARNARESH SINGH GILL , J. (ORAL) Case is taken up for hearing through video conferencing. The petitioner seeks regular bail in FIR No. 89 dated 4.4.2020 under Sections 21/65 of NDPS Act, 1985, registered at Police Station Sadar Hansi.

Learned counsel for the petitioner submits that recovery of 50 grams of heroin is allegedly effected from the petitioner; that he has been in custody since 04.4.2020; that co-accused Sunil Kumar, whose case is on the similar footing and is involved in two cases, has also been granted regular bail; that similar is the case of co-accused Sandeep, from whom 150 grams of heroin has been recovered and he has also been granted regular bail; and that so far as other cases are concerned, the petitioner is on bail in those cases.

On the other hand, learned State counsel submits that out of 16 GURPREET SINGH 2021.07.02 15:46 I attest to the accuracy and integrity of this document Chandigarh prosecution witnesses, one has been examined and the next date before the

CRM-M No. 15191 of 2020 -2trial Court is 05.7.2021.

The petitioner has been in custody since 04.4.2020. The other co-accused are already on regular bail. Moreover, out of 16 prosecution witnesses, only one has been examined. The trial will take time to conclude because of Covid-19 pandemic. No useful purpose would be served by keeping the petitioner behind the bars.

Without commenting anything on the merits of the case, the petition is allowed and the petitioner is ordered to be released on bail on his furnishing bail/surety bonds to the satisfaction of the trial Court/Duty Magistrate.
