(Oral) Prayer in the present petition filed under Section 439 of the Code of Criminal Procedure, 1973 is for grant of regular bail to the petitioner in case FIR No.464 dated 18.12.2019 u/s 365/34 and 201 IPC and Section 120-B (added later on) registered at Police Station City Zirakpur, District SAS Nagar (Annexure P-1).

Learned counsel for the petitioner has relied upon order dated 10.06.2020 passed in CRM-M-12830-2020 Lakhwinder Singh @ Gagan Vs. State of Punjab (Annexure P-5), wherein the co-accused of the petitioner has been admitted on bail. He further submits that families of the petitioner and the complainant are known to each other. Criminal Misc. No.M-15314 of 2020 -2he has referred to their joint photographs (Annexure P-2). The petitioner is in custody since 01.01.2020.

Learned State counsel does not dispute the custody of the petitioner. However, he submits that there is another FIR i.e. FIR No.147/2013 under Sections 420/467/120-B IPC P.S. Dirbha registered against the petitioner, wherein he is already on bail. I have heard learned counsel for the parties. Considering the fact that the petitioner is in custody since 01.01.2020 and trial in the case will take sufficient long time and no useful purpose would be served by keeping the petitioner in custody, this Court deems it appropriate to release the petitioner on regular bail. Accordingly, the present petition is allowed and the petitioner is admitted on regular bail, subject to furnishing of his bail bonds/surety bonds to the satisfaction of trial Court/Duty Magistrate.
