The petitioner is seeking regular bail under Section 483 Bharatiya Nagarik Suraksha Sanhita, 2023 (BNSS) in FIR No.225 dated 29.12.2023 under Section 379B(2) IPC (201, 411 IPC added later on), registered at Police Station Kamboj, District Amritsar.

The allegations against the petitioner are that he has snatched mobile phone as well as Rs.8,000/- in cash and a purse containing some important documents.

Learned counsel for the petitioner contends that the petitioner has been custody for more than a period of 01 year. He further contends that the co-accused in the present case has already been granted bail vide order dated 04.12.2024 (Annexure P-3) passed by this Court.

Mr. Kamalpreet Bawa, AAG, Punjab, accepts notice on behalf of the respondent-State. He vehemently opposes the grant of concession of regular bail by way of filing custody certificate dated 01.04.2025. He further states that charges against the petitioner have been framed where out of total 09 prosecution witnesses, one witness has already been examined.

I have heard learned counsel for the parties and have gone through the material placed on record.

Keeping in view the facts and circumstances of the present case, and that the petitioner is in custody for a period of 01 year, 02 months and 08 days. Only one prosecution witness out of total 09 PWs, has been examined and therefore, the conclusion of the trial is likely to take some time, I deem it a fit case to grant the concession of regular bail to the petitioner. 8.
Therefore, without expressing any opinion on the merits of the case, the instant petition is allowed. The petitioner is ordered to be released on regular bail on his furnishing requisite bonds to the satisfaction of the trial Court/Duty Magistrate concerned.
