The instant petition has been filed under Article 226 of the Constitution of India for issuing a direction to the official respondents to protect the life and liberty of petitioner at the hands of private respondents and not to harass her in any manner.

It is contended that the petitioner was married to Jatinder Singh son of Kulwant Singh but had a strained relationship with her husband. Her husband has shifted to Malaysia for work purpose and did not return home from last five years. He had taken loan from various financers in Jalandhar but did not repay the loan. Now the financers are threatening the petitioner for dire consequences if their money is not returned. Even the family members of husband of the petitioner had harassed her on account of nonpayment of loan to the financers and forced her to move out of her matrimonial home. The petitioner is now residing in a rented accommodation. On 09.06.2020, the petitioner has given a representation through post to respondent No.2 in this regard but no action has been taken so far on the same.

On a specific query raised by this Court whether the petitioner is a signatory to any loan document, learned counsel for the petitioner makes a statement at bar that the petitioner is not a signatory to any loan document.

At this stage, on the asking of the Court, Mr. Gaurav Dhuriwala, Sr. DAG, Punjab who is present through the medium of Video Conferencing, accepts notice on behalf of the official respondents and submits that the official respondents will look into the matter and will take a decision on the representation of the petitioner. Let a copy of complete paper book be e-mailed to the counsel appearing for the official respondents today itself before 12 noon .

In view of the above, I dispose of the instant petition by directing the official respondents to take a decision on the representation dated 09.06.2020 (Annexure P-1) of the petitioner as expeditiously as possible and preferably within a period of two weeks from today in accordance with law by passing a speaking order and if there is any merit found in the contention raised by the petitioner, adequate protection be provided to her.
