(Oral) This petition has been filed under Section 439 Cr.P.C. seeking regular bail to the petitioner in a case FIR No.29 dated 14.02.2017 under Section 420 IPC, registered at Police Station Dharamkot, District Moga. Learned counsel for the petitioner submits that petitioner is incarcerated since 03.04.2017 and the offence is triable by Magistrate. Learned State counsel has opposed the prayer for bail. However, he submits that out of 13 witnesses cited by the prosecution, 03 have been examined.

Heard.

Keeping in view the fact that the offence is triable by Magistrate, period of his incarceration and trial may take long time to conclude, no useful purpose would be served by detaining the petitioner during pendency of the trial, I deem it appropriate to grant regular bail to the petitioner. Accordingly, petition is allowed and the petitioner is ordered to be enlarged on bail to the satisfaction of Chief Judicial Magistrate/Duty Magistrate, Moga.
