The petitioner through instant petition under Articles 226/227 of the Constitution of India is seeking setting aside of order dated 26.02.2026 whereby respondent has rejected his request to correct his details in the birth certificate.

The petitioner requested respondent to make correction in his birth certificate with respect to his name as well as name of parents. The respondent by impugned order while relying upon Section 15 of Registration of Births and Deaths Act, 1969 (for short '1969 Act') has rejected his request.

Learned State counsel at the outset submits that Haryana Registration of Births and Deaths Rules, 2002 stands repealed and 1969 Act has been amended. Section 25A has been inserted in 1969 Act w.e.f. DEEPAK BISSYAN 2026.03.13 18:02 I attest to the accuracy and integrity of this document

CWP-7601-2026 -201.10.2023. As per said Section, the petitioner has remedy to file appeal against order of Registrar.

Faced with this, learned counsel for the petitioner seeks permission to withdraw the petition with liberty to file appeal before appellate authority.
