The petitioner through instant petition under Articles 226/227 of the Constitution of India is seeking writ of quo warranto calling upon respondent No.8 to show cause authority under which he is holding public office of Executive Engineer in Urban Local Bodies Department, Haryana. He is further seeking setting aside of B.Tech. (Civil Engineering) degree of respondent No.8. He is further seeking direction to official respondents to remove respondent No.8 from the post of Executive Engineer.

The respondent No.8 was working as Municipal Engineer in Municipal Corporation, Yamunanagar and was subsequently promoted to the post of Executive Engineer. He at present is posted at Panipat. CWP-7639-2026 -2Institutions, Jhajjar. He attended second shift of classes during August' 2014 to May' 2017 while working at Yamunanagar. The distance between Jhajjar and Yamunanagar is 216 Kms. MDU, Rohtak vide letter dated 16.05.2017 intimated to CBS Group of Institutions that class timings from 06:00 PM to 09:20 PM are in violation of All India Council for Technical Education norms. Respondent No.8 scored 4206 marks out of 6100 in the examination of B.Tech. (Civil Engineering). CBS Group of Institutions vide verification letter dated 16.07.2018 informed Director, Urban Local Development Bodies, Haryana that classes were held in second shift from 06:00 PM to 09:20 PM and student had 70% overall attendance. The petitioner has filed complaint on CM Window Portal but to no avail.

Learned State counsel, who on advance notice is present in Court, accepts notice on behalf of respondent-State assures the Court that competent authority would look into the matter and do the needful. 4.
