(ORAL) Prayer in this petition is for grant of regular bail in FIR No.40 dated 02.07.2019 under Sections 21 & 29 of NDPS Act, registered at Police Station Kacha Pacca, Tehsil Patti, District Tarn Taran. Learned counsel for the petitioner submits that co-accused Ranjodhanbir Singh @ Jodhan and Shubampreet Singh @ Shubam, who had been arrested at the spot, have already been granted the concession of regular bail vide order dated 18.12.2019 passed in CRM-M-37131-2019 and order dated 02.03.2020 passed in CRM-M-46806-2019. Similarly another co-accused Chandpreet Singh @ Chandi has been granted the concession of regular bail vide order dated 16.12.2019 passed in CRM-M-52594-2019. It is further submitted that as per allegations in the FIR, petitioner Gurjant Singh @ Janta ran away from the spot, therefore, his identity is yet to be established.
CRM-M-15193-2020 -2Learned State counsel, on instructions, has not disputed the factual position. It is also not disputed that the petitioner is not involved in any other case.
Without commenting anything on merits of the case, considering the fact that three co-accused have already been released on regular bail and the petitioner was not arrested from the spot, this petition is allowed and the petitioner is directed to be released on regular bail subject to furnishing his bail/surety bonds to the satisfaction of the trial Court/Illaqa Magistrate/Duty Magistrate, concerned.
Petition is disposed of.
