This petition has been filed under Section 439 Cr.P.C. for grant of regular bail in case FIR No.634 dated 4.8.2016 registered for the offences under Sections 25 and 29 of the Arms Act, Sections 398 and 401 IPC and Section 21 of the Narcotic Drugs & Psychotropic Substances Act, 1985 at Police Station Sadar Hisar, District Hisar.
Notice of motion has been issued in this case. Mr. Vikramjit Singh, learned Additional Advocate General, Haryana has put in appearance on behalf of the respondent-State and contested this petition.
I have heard learned counsel for the petitioner as well as learned Additional Advocate General, Haryana appearing for the respondent-State and have gone through the record. Harpal Singh Parmar 2016.08.27 16:20 I attest to the accuracy and authenticity of this document Chandigarh
Cr. Misc. No.M-29226 of 2016 [2] From the record, I find that a pistol has been recovered from the co-accused of the petitioner when the raid was conducted. On the basis of disclosure of the main accused and it was stated by the main accused that he purchased the revolver from the present petitioner. Thus, the present petitioner has been nominated on the disclosure of the co-accused. The petitioner has been in judicial custody since 5.8.2016. He is not required for investigation or interrogation purposes as he is in judicial custody. The trial of the case will take long time. No useful purpose will be served by keeping the petitioner in custody till the final disposal of the case.
Therefore, keeping in view the facts and circumstances of the present case; without discussing the facts in minute detail and without expressing any opinion on the merits of the case, this criminal miscellaneous petition is allowed and the petitioner is ordered to be released on bail subject to his furnishing personal bond in the sum of `40,000/- with one surety in the like amount to the satisfaction of the trial Court/Duty Magistrate.
Copy of this order be given dasti to the counsel for the petitioner attested under the signatures of the Bench Reader of this Court. August 27, 2016.
