Rajan Gupta, J (Oral) This is a petition under Section 439 Cr.P.C. seeking regular bail in a case registered under Sections 377, 342, 506, 34 IPC and Section 66-A of I.T.Act vide FIR No. 60 dated 23.12.2014 at Police Station, Lakhewali, District, Sri Muktsar Sahib.

Learend counsel for the petitioner submits that complainant has already deposed before the trial court. Petitioner is in custody since 25.12.2014. He further submits that since the trial is already in progress, no useful purpose will be served by detaining the petitioner any longer. Keeping in view the fact that complainant has already deposed before the trial court and period of incarceration of the petitioner, I am of the considered view that no useful purpose would be served by detaining the petitioner any longer. The trial may take long time to conclude. Thus, without expressing any opinion on the merits of the case, this petition is allowed and the petitioner is directed to be released on bail to the satisfication of Chief Judicial Magistrate/ Duty Magistrate, Sri Muktsar Sahib.
