Prayer in the instant petition filed under Section 482 Cr.P.C. is for directing respondent Nos.1 to 3 to perform their imperative corresponding duty and protect the petitioners from harassment, pressure and subjugation from the police and also to ensure that petitioners can cultivate their own land, which is owned and possessed by them. A further prayer has been made for issuing direction to respondents No.2 and 3 to take legal action against the guilty police officials i.e. respondents No.4 & 5, who are harassing and threatening the petitioners to not to cultivate their own land, which is owned and possessed by them, as per the land record, which is annexed as Annexure P-1 along with the instant petition.

Learned counsel for the petitioners has reiterated his allegations and submitted that the private respondents in collusion with the official respondents i.e. respondents No.4 & 5, have been subjecting the petitioners to not only continuous harassment, but also during the pendency of the instant JAWALA RAM 2021.02.17 14:42 I attest to the accuracy and authenticity of this document Chandigarh

CRM-M-15165-2020 - 2 - petition indulged in cutting of trees from the land of the petitioners and thereafter, selling them in the market. It has been further submitted that despite repeated and continuous complaints dated 17.11.2019 and 01.12.2019 (appended as Annexures P-1 & P-2, respectively) and representations dated 27th April, 2020 and 15th May, 2020 (appended as Annexures P-11 & P-13, respectively), having been made to the authorities concerned, the private respondents are preventing the petitioners to enter in their land and cultivating the same.

After arguing for some time, learned counsel for the petitioners submits that he would be satisfied that if the petition is disposed of with a direction to the official respondents No.2 & 3 to look into the complaints/representations purportedly made to the authorities concerned by the petitioners and take appropriate action thereon in accordance with law. 4.

In view of the limited prayer made by the petitioner, the petition is disposed of with a direction to respondents No.2 & 3, to look into the complaints dated 17.11.2019 and 01.12.2019 and representations dated 27.04.2020 and 15.05.2020 (appended as Annexures P-1, P-2, P-11 & P-13, respectively) and take necessary steps, if any required, in accordance with law.
