Mr. Sartaj Singh Gill, Senior Deputy Advocate General, Punjab, on advance copy, accepts notice on behalf of the respondents. 3.

The petitioner is before this Court invoking writ jurisdiction of this Court against the alleged demolition of Dhaba situated in rural area of Jalandhar district.

After having heard learned counsel for the rival parties and going through the record, it appears that demolition had already taken place and therefore, only two remedies available to the petitioner are either to claim damages for unlawful demolition of her property without following the due process of law and also for an appropriate enquiry to find out the culprits behind the act of demolition. As regards enquiry is concerned, the petitioner has made a representation vide Annexure P-3 to the Commissioner of Police, Jalandhar on 09.03.2025 which appears to have not been attended to as yet. 6.

Accordingly, this petition stands disposed of with liberty to the petitioner to avail the remedy before the Civil Court for claim of damages and also with a direction to the Commissioner of Police, Jalandhar to decide the representation dated 09.03.2025 (Annexure PB3) moved by the petitioner by passing a speaking order within a period of 15 days from the date of receipt of a copy of this order and thereafter communicate the decision to the petitioner. It is made clear that this Court has not expressed any opinion on the merits of the case and the Commissioner of Police, Jalandhar is free to decide the matter in accordance with law.
