Learned counsel for the petitioner inter alia places reliance upon the order dated 05.02.2024, passed in CWP-2330-2024 (Dr. Sandeep Kumar vs. Panjab University, Chandigarh and others), wherein, following order was passed:- "108 CWP-2330-2024 DR. SANDEEP KUMAR V/S PANJAB UNIVERSITY, CHANDIGARH AND ORS.

Counsel for the petitioner, inter alia, contends that the Advertisement No.1/2023, dated 15.11.2023 (Annexure P-1), made by respondent No.1, for filling up the 18 posts of Assistant Professors in different teaching Departments, is against the directions dated 19.10.2020 (Annexure P-6), issued by respondent No.2 [University Grants Commission (UGC)], and the instructions dated 02.07.1997 (Annexure P-7), issued by respondent No.3 (Union of India), because, the roster register of reservation has not been followed.

Notice of motion.

On advance notice, Mr. Akshay Kumar Goel, Advocate, puts in appearance on behalf of respondent No.1 and files his memo of appearance, and Mr. Satya Pal Jain, Addl. Solicitor General of India, assisted by Ms. Divya Sharma, Sr. Panel Counsel, puts in appearance on behalf of respondent No.3. Requisite copies of the complete paper book have already been handed over to learned counsel appearing on behalf of respondents No.1 & 3.

Let a copy of the writ petition be delivered to the counsel, who ususally appears on behalf of the University Grants Commission (respondent No.2 herein), and Mr. Vipin Pal Yadav, Addl. AG, Punjab (respondent No.4 herein), during course of the day.

Learned counsel for respondents No.1 & 3, seek time to get instructions and address arguments.

Learned counsel further submits that now the aforesaid case is pending adjudication for 09.05.2025, before this Court.

The aforesaid order was followed by order dated 10.09.2025 which reads as:- "

Learned counsel for respondent, during the course of hearing, produced corrigendum to advertisement Nos.2/2025, 02/2024 and 02/2022. The same is taken on record as Annexure 'X'. Registry is directed to tag the same at an appropriate place. As per corrigendum, the process of filling up of posts which were reserved for Persons with Disabilities ('PWD') Category is put on hold. Learned counsel for the respondent submits that a Committee is identifying posts vis-a-vis PWD Category. As soon as posts are identified, the needful would be done. The committee needs at least three months time.

Adjourned to 12.12.2025.

The petitioner would be free to move an appropriate application, if respondent-University tries to fill up the posts contrary to provisions of Rights of Persons with Disabilities Act, 2016."

CWP- 7440 of 2024 (O&M) -4Learned counsel for the respondent submits that posts for PWD are identified, however, approval of Syndicate as well as Senate is required. At present, there is no Senate and elections of Senate are scheduled for September' 2026. As soon as Senate is constituted, the matter would be considered. Till the constitution of Senate, no vacancy would be filled up. The vacancies would be filled up the moment Senate is constituted and posts identified by competent authority are approved by Senate. The posts may be re-advertised through fresh advertisement or filled up through impugned advertisement.

In the wake of statement of learned counsel for the respondent, the petition stands disposed of with liberty to petitioner to avail remedies as permissible by law, if at any stage he feels aggrieved from the process initiated by respondent for filling up posts in question. 5.
