The above two petitions are filed under Section 482 of the Code of Criminal Procedure for quashing of F.I.R. No.31 dated 22.5.2014 registered under Sections 452/307/34 I.P.C. and Sections 25,54,59 of the Arms Act at Police Station Phul and cross-case registered vide D.D.R. No.27 dated 22.5.2014 under Sections 452,323,148,149 I.P.C. at Police Station Phul (in F.I.R. No.31 dated GHANSHYAM DASS 2015.03.04 12:33 I attest to the accuracy and authenticity of this document high court chandigarh

Cr.M.No.M-2838 of 2015 -222.5.2014) and all consequential proceedings arising therefrom on the ground that the parties have entered into a compromise.

This case pertains to cross-versions.

On 28.1.2015 this Court directed the parties to appear before the trial Court and get their statements recorded in support of their claim that the matter has been compromised. Trial Court was also directed to send the report about the factum of compromise and also the fact that such statements were not a result of any undue pressure or coercion.

Report has since been received along with copies of the statements of the affected persons which also indicates that the matter has been resolved amicably between the parties without any pressure from any quarter. Having regard to the aforesaid and the observations of Full Bench in Kulwinder Singh v. State of Punjab 2007(3) Law Herald 2225, and Gian Singh v. State of Punjab 2012(4) R.C.R. (Crl.)543, both the petitions are allowed. Consequently, F.I.R. No. No.31 dated 22.5.2014 registered under Sections 452/307/34 I.P.C. and Sections 25,54,59 of the Arms Act at Police Station Phul and cross-case registered vide D.D.R. No.27 dated 22.5.2014 under Sections 452,323,148,149 I.P.C. at Police Station Phul (in F.I.R. No.31 dated 22.5.2014) and all consequential proceedings arising therefrom are hereby quashed qua the petitioners.
