**** ANITA CHAUDHRY, J The petitioner is seeking regular bail in FIR No. 34 dated 18.3.2018 registered at Police Station Sadar, Kapurthala under Sections 323, 354, 379-B, 506 IPC.

Counsel for the petitioner contends that the case was adjourned on the last date so that the complainant could make a statement and the zimni orders placed on record show that though the victim was present on 27.8.2018 but her statement was not recorded as Court time was over and she was bound down for the next date but she failed to appear on the next date.

The zimni order dated 7.9.2018 shows that no witness was present though in the earlier order the witness had been bound down. The petitioner had placed on record the photographs to show that the girl was sitting in a restaurant along with the petitioner. Subsequently the FIR had been lodged and the girl was got medically examined. The case of the GURPREET SINGH 2018.09.18 13:26 I attest to the accuracy and authenticity of this document chandigarh

Crl. Misc. No. M-29378 of 2018 -2petitioner is that the girl had been beaten up by her family and false allegations have been made against him. The complainant is avoiding the witness box. The trial would take time.

Without commenting anything on the merits of the case, the petition is allowed and the petitioner is ordered to be released on bail on his furnishing bail/surety bonds to the satisfaction of the trial Court/Duty Magistrate with the condition that he will not contact the victim.
