M.M.S. BEDI, J. (ORAL) Petitioner seeks a direction from this Court to the State authorities to register an FIR on the basis of a complaint alleging that Rachan Kaur has sold the property more than her 1/6th share by different sale transactions, as such, prosecution should be launched. The petitioner had earlier filed a complaint to the Senior Superintendent of Police, Rup Nagar, regarding the Will having been forged by Rachan Kaur as FIR No.18 of 2007 at Police Station, Rup Nagar, but later on it was compromised between the parties and the FIR was quashed on the basis of the order passed by the High Court. The grievance of the petitioner is that on account of Rachan Kaur having sold share more than her ownership, a criminal case should be registered against her.

I have heard the learned counsel for the petitioner

CRM-M-28400-2015 (O&M) and I am of the opinion that the allegations of the petitioner have already been looked into by the Superintendent of Police (Local), Rup Nagar and enquiry report has already been prepared, a copy of which is appended with the case as Annexure P5. Counsel for the petitioner after arguing for some time, seeks permission to withdraw the petition with liberty to take legal action against the above said accused by filing a complaint. Dismissed as withdrawn without prejudice to the legal rights of the petitioner.
