This is a third petition preferred by petitioner under Section 438 Cr.P.C. seeking pre-arrest bail, feeling apprehension of arrest in case FIR No.14 dated January 19, 2016 under Sections 304, 323, 34 IPC registered at Police Station, Sadar, Fazilka. 2.

Earlier, petitioner alongwith her co-accused filed CRM No.M-32082 of 2016 which was dismissed as withdrawn qua petitioner No.1 - Preeto Bai vide order dated September 29, 2016. Another petition viz. CRM No.M-43513 of 2016 was also dismissed as withdrawn vide order dated December 13, 2016. The instant petition being the third petition having been filed on the same cause of action, with no substantive change in fact situation, is not maintainable. Moreover, petitioner has been attributed brick blow to Indro Bai who died on the way to Civil Hospital, Fazilka. Avin Kumar 2017.09.27 13:32 I attest to the accuracy and integrity of this document

Crl. Misc. No.M-28466 of 2017 [2] Allegations against the petitioner are serious in nature in as much as death of Indro Bai was caused during the occurrence which took place between the complainant and accused party.
