The petitioner through instant petition under Article 226/227 of the Constitution of India is seeking setting aside of punishment order dated 05.10.2001.

The petitioner was placed under suspension on 13.11.1997. He was reinstated on 07.05.1998. He was awarded punishment of stoppage of one increment without cumulative effect. He was not awarded full salary for the suspension period though he was paid subsistence allowance. The petitioner is claiming full salary for the suspension period.

The petitioner was awarded punishment, thus, cannot claim full salary for the suspension period. He was rightly paid subsistence allowance.
