This is a petition for anticipatory bail filed under Section 482 of Bharatiya Nagarik Suraksha Sanhita, (BNSS), 2023 in case bearing FIR No.273 dated 15.12.2023 under Sections 379, 34 IPC registered at Police Station Jamalpur, District Ludhiana.

The case of the prosecution is that the petitioner runs a tent house and the complainant is in business of giving boarding blocks on rent for the purpose of setting the stage. The first informer admits that she had received Rs.8000/- for setting up a stage at Dana Mandi, Ludhiana and on the same day the petitioner had set up a tent for some function at Dana Mandi, Ludhiana. As per FIR, the complainant was informed to take back the stage after the function was over, however the stage was not there.

Learned counsel for the petitioner contends that the petitioner is innocent and has been falsely implicated in the present case. CRM-M-14865-2025 -2the complainant has no objection in case the petitioner is granted the concession of anticipatory bail.

A Coordinate Bench of this Court, vide order dated 19.03.2025, had directed the petitioner to appear before the Investigating Officer and join investigation and in the event of his arrest, he was ordered to be released on adinterim bail to the satisfaction of the Investigating/Arresting Officer, subject to the conditions envisaged under Section 438(2) Cr.P.C. 4.
Learned State counsel on instructions states that the petitioner has joined the investigation and is not required for custodial interrogation. 5.
In view of the submissions of learned counsel for the petitioner especially when the petitioner has cooperated with the investigation officer, the order dated 19.03.2025 granting interim bail to the petitioner is made absolute. 6.
However, the petitioner shall abide by the conditions stipulated under Section 438(2) Cr.P.C. He shall also join investigation as and when called upon to do so.

The petition stands allowed.
