The present revision petition has been filed challenging the order dated 10.02.2025 (Annexure P-7) whereby the application filed by the plaintiff-petitioners under Order 6 Rule 17 of the Code of Civil Procedure, 1908 for amendment of the plaint has been dismissed. 2.

Learned counsel for the plaintiff-petitioners states that respondent No.2 who is defendant No.2 in the case was proceeded against ex parte vide order dated 23.08.2024. Learned counsel for the parties are ad idem that service of respondent No.2 would not be necessary in the present case. Ordered accordingly.

Learned counsel for the LRs of respondent No.1 on instructions from the parties states that they would have no objection if the amendment application is allowed.

In view of the statement made by the learned counsel for the LRs Yogesh Sharma 2025.07.31 10:17 I attest to the accuracy and authenticity of this judgment/order.

CR-1614-2025 (O&M) -2of respondent No.1, the impugned order dated 10.02.2025 (Annexure P-7) is set aside and accordingly the amendment application stands allowed. 5.
