(ORAL) The petitioner is seeking anticipatory bail in case FIR No.176 dated 19.11.2019 under Sections 21 and 29 of NDPS Act and Section 25 of Arms Act (Section 411 IPC added later on), registered at Police Station City Batala, District Batala.

Learned counsel for the petitioner submits that pursuant to order dated 16.06.2020 passed by this Court, the petitioner has joined the investigation and has fully cooperated in the same. 3.
On a query of the Court, learned State counsel, under instructions from ASI Surinder Singh, submits that petitioner has joined the investigation and his statement has been recorded. He further submits that at this stage, custodial interrogation of the petitioner is not required and in the course of investigation, if at later stage, it unfolds and is found that his custody is required, appropriate application shall be moved. In view of the above, since custodial interrogation of the petitioner is no longer required as he has already joined the investigation and also cooperated with the Investigating Officer, the petition is allowed. Order dated 16.06.2020 passed by this Court, granting interim anticipatory bail to the petitioner is hereby made absolute, subject to his complying with the conditions as envisaged under Section 438 (2) Cr.P.C.

The petition stands disposed of accordingly.
