Petitioner has filed this petition under Section 438 Cr.P.C. for grant of anticipatory bail in case FIR No.05 dated 09.03.2017 under Sections 409, 420, 467, 468, 471, 120-B IPC and Section 13(1) (d) and 13
(2) of the Prevention of Corruption Act, registered at Police Station Vigilance Bureau, District Jalandhar.
Notice of motion was issued. Learned State counsel appeared and contested the petition.
I have heard learned counsel for the petitioner as well as learned State counsel and have gone through the record. From the record, I find that as per allegations in the FIR, in the Khazana of State Bank of Patiala, Sultanpur Lodhi, District Kapurthala, a VINEET GULATI 2018.08.03 17:08 I attest to the accuracy and authenticity of this document Chandigarh
CRM No.M-29518 of 2018 -2fraud was committed by way of Limits/Rents. From the perusal of 14 files of loan w.e.f. 01.05.2013 to 30.04.2016, embezzlement of `3.71 crores has been found to be committed and from other files, in respect of agricultural land, embezzlement of about `15.83 crores has been unravelled. The allegation against the present petitioner is that he obtained fake copy of jamabandi in connivance with Patwari and got sanctioned a loan and has not returned a single penny.
Keeping in view the serious allegations against the petitioner, and without discussing the facts in minute detail and without expressing any opinion on the merits of the case, I find that petitioner is required for custodial interrogation and no ground is made out for granting anticipatory bail to him.
Therefore, finding no merit in the present petition, the same is dismissed.
