(Oral) Prayer in this petition is for quashing of FIR No.18 dated 15.2.2021 (Annexure P-1), under Sections 406 and 498-A IPC, registered at Women Police Station, Chandigarh, on merits. After arguing for some time, when this Court was not inclined to grant any relief, learned counsel for the petitioners prays for withdrawal of the present petition with liberty to take all the pleas before the learned trial Court. However, learned counsel for the petitioners submits that petitioner No.1 who is mother-in-law of the complainant is 67 years old and petitioner No.2, who is father-in-law of the complainant, is 72 years old. Learned counsel for the petitioners also refers to the medical records of the petitioners as Annexures P-6 and P-7 respectively to submit that both the petitioners are senior citizens and suffering from multiple health issues and it is VIJAY ASIJA 2024.04.03 17.01 I attest to the accuracy and integrity of this document

2024:PHHC:044234 CRM-M-15981-2024 accordingly prayed that the petitioners may be granted permanent exemption from personal appearance before the learned trial Court during pendency of the trial.

I have heard learned counsel for the petitioners. The present petition is ordered to be dismissed as withdrawn with liberty to the petitioners to take all the pleas before the learned trial Court. However, if an application for exemption from personal appearance before the learned trial Court is filed by the petitioners, the same shall be considered sympathetically.
